

General Terms and Conditions of Sale – ROOT 64 Applicable from April 1, 2026
Article 1: Purpose These General Terms and Conditions of Sale (GTC) govern the contractual relations between ROOT64, EI, whose registered office is located at 12 Allée du Fer à Cheval, Biarritz, registered with the CMA of Bayonne, and represented by Philippe Robeyns (hereinafter referred to as "the Service Provider"), and any natural or legal person (hereinafter referred to as "the Client") wishing to benefit from the services of excursions and tourist circuits on vintage Harley-Davidson motorcycles with a driver offered by the Service Provider.
Article 2: Services Offered The Service Provider offers paid passenger transport services on vintage Harley-Davidson motorcycles, driven by experienced professional drivers, specifically qualified and authorized for paid passenger transport. The services include:

Unique rides and tourist circuits aboard vintage Harley-Davidson motorcycles.

Provision of expert drivers, holders of all required licenses and qualifications for paid passenger transport, and deeply knowledgeable about driving these specific models.

Loan of all necessary approved safety equipment for the passenger: helmet, gloves. Other equipment (such as a jacket) may be offered depending on the service and availability.

Regular and rigorous maintenance of the motorcycles, ensuring their reliability and safety. The motorcycles are specifically insured for this paid passenger transport activity.
The itineraries will be agreed upon in advance with the Client to best adapt to their expectations and ensure a personalized experience. The details of each service (itinerary, duration, price, inclusions and exclusions) will be specified at the time of booking and on the order confirmation.
Article 3: Booking and Confirmation

Booking Process: The Client may make a booking request by exchange via email, telephone, or directly through the Service Provider's website.

Quote and Itinerary: For any request, a detailed quote and itinerary proposal will be prepared by the Service Provider, in accordance with the Client's expectations.

Acceptance and Confirmation: The booking is considered firm and final only after:

Full payment of the service by bank transfer or credit card at the time of booking, which constitutes acceptance of these GTC.

Sending by the Service Provider of a booking confirmation to the Client by email, detailing the booked service, the price, the date, time and meeting place, as well as the agreed itinerary.

Client Information: The Client undertakes to provide accurate and complete information at the time of booking, particularly regarding the identity of the passengers, their age, their weight and any information relevant to their safety.
Article 4: Prices and Payment Terms

Prices: The prices are fixed for the agreed service and indicated in euros (€) including all taxes (VAT included). They include the driver's service, the use of the vintage Harley-Davidson motorcycle, fuel and the loan of the safety equipment mentioned in Article 2. The prices do not include meals, unless prior and explicit agreement at the time of booking. They also do not include drinks, ancillary activities (site visits, museums, etc.) unless expressly stated otherwise in the booking confirmation.

Payment Terms: Full payment of the service is due at the time of booking by bank transfer or credit card. Any unpaid service cannot be confirmed or performed.

Invoicing: An invoice will be provided to the Client after full payment of the service.
Article 5: Cancellation and Postponement

Cancellation by the Client:

Any cancellation must be notified to the Service Provider in writing (email or registered mail with acknowledgment of receipt).

In case of cancellation:

More than 7 days before the service date: Full refund of the amounts paid.

Less than 7 days before the service date: Refund of 50% of the total amount of the service.

In case of no-show by the Client at the agreed time and meeting place, the full amount of the service will remain due and no refund will be made.

Cancellation by the Service Provider:

The Service Provider reserves the right to cancel a service for legitimate reasons, particularly in case of dangerous weather conditions, unforeseen mechanical breakdown of the vehicle, driver's illness, or any other unforeseen circumstance making the service impossible or dangerous.

In this case, the Service Provider will offer the Client a full refund (100%) of the amounts paid, or a postponement to a later date if the Client so wishes, without the Client being able to claim additional damages.

Postponement for Weather Conditions (specific):

In case of unfavorable weather conditions (heavy rain, strong wind, storm, etc.) making the ride dangerous or unpleasant, the Service Provider reserves the right, at its sole reasonable discretion, to propose a postponement of the service to a later date agreed upon mutually with the Client. In this situation, postponement is the preferred solution to ensure the Client's safety and enjoyment.

Modification by the Client: Any request for modification (date, time, itinerary) must be addressed to the Service Provider in writing and will be subject to mutual agreement. Additional fees may be applied depending on the requested modification.

Modification by the Service Provider: The Service Provider reserves the right to modify the itinerary or schedule for safety reasons, traffic conditions, road works or any other constraint beyond its control. The Client will be informed as soon as possible.
Article 6: Transport Conditions and Passenger Safety

Passenger Requirements:

The passenger must be at least 14 years old. The Service Provider reserves the right to request proof of identity.

The passenger must be in good physical condition and fit to travel by motorcycle. The Service Provider cannot be held responsible for health problems occurring during the service if the passenger has not reported any medical history or contraindications.

Safety Instructions:

The passenger undertakes to strictly follow all safety instructions given by the driver before and during the ride.

Wearing an approved helmet and approved gloves is mandatory. This equipment will be loaned by the Service Provider and must be worn correctly throughout the journey.

The passenger must not be intoxicated or under the influence of drugs before and during the service. The driver reserves the right to refuse departure if a passenger is under the influence of these substances, without possibility of refund.

The passenger must remain seated, not move unnecessarily and maintain a good position throughout the journey.

Behavior and Compliance with Legislation:

In case of dangerous, inappropriate or disrespectful behavior by the passenger endangering their safety, that of the driver or others, the Service Provider reserves the right to interrupt the service immediately, without possibility of refund for the Client.

The activity takes place in strict compliance with French legislation and the Highway Code. The passenger undertakes to comply with all applicable rules.

Article 7: Responsibilities and Insurance

Service Provider's Liability: The Service Provider undertakes to perform the services with diligence, professionalism and in complete safety. Its liability is limited to the amount of the sums paid by the Client for the service.

Insurance:

The vintage Harley-Davidson motorcycles are specifically insured for the paid passenger transport activity.

The drivers are also covered by Professional Liability insurance in the context of their professional duties.

Exclusions of Service Provider's Liability: The Service Provider cannot be held responsible:

For delays or cancellations due to unforeseen force majeure events (exceptional traffic jams not related to the agreed itinerary, accidents external to the service not attributable to the Service Provider, etc.).

For lost, stolen or damaged items belonging to the Client during the service.
-
For damages resulting from the Client's failure to comply with safety instructions or these GTC.

For incidents or accidents occurring if the passenger has not respected the rules of prudence and the driver's instructions.

Client's Liability: The Client is responsible for any damage caused intentionally or unintentionally to the motorcycle, the provided equipment or to third parties due to their fault or negligence. They undertake to indemnify the Service Provider for the damages suffered.
Article 8: Image Rights Photos and videos may be taken during the outings to immortalize the experience and be shared with the clients. The Service Provider undertakes to request the Client's explicit authorization before any use of these photos or videos for commercial purposes (advertising, website, social networks, etc.). The Client is free to refuse this authorization.
Article 9: Personal Data The Service Provider undertakes to respect the confidentiality of personal data collected from the Client and to process them in accordance with the General Data Protection Regulation (GDPR). The data is used solely for managing bookings, invoicing and communication related to the service. The Client has the right to access, rectify, delete and object to their personal data. To exercise these rights, the Client can contact the Service Provider at team.root64@gmail.com.
Article 10: Intellectual Property All elements of the website www.root64-btz.com, communication materials and the Service Provider's visual identity (texts, images, logos, etc.) are the exclusive property of the Service Provider and are protected by copyright and trademark law. Any reproduction, representation, modification or exploitation, total or partial, of these elements is strictly prohibited without the prior written authorization of the Service Provider.
Article 11: Disputes and Applicable Law

Complaint: Any complaint regarding the service must be addressed in writing to the Service Provider within 15 days after the service date, at the address team.root64@gmail.com.

Mediation: In case of an unresolved dispute amicably, the consumer Client may resort free of charge to a consumer mediator. The contact details of the mediator to which the Service Provider belongs are as follows: [Name of the consumer mediator, address, website].

Applicable Law and Competent Jurisdiction: These GTC are governed by French law. Any dispute relating to their interpretation or execution, in the absence of an amicable resolution, will be brought before the competent courts of Bayonne.
Article 12: Acceptance of the GTC Booking or participation in the activity implies full and unreserved acceptance of these General Terms and Conditions of Sale by the Client.
